Avalon Solution Sagl (hereafter, “Avalon“) provides users of the Avalon website (hereafter, the “Site,” which can be visited at https://avalonsolution.ch/) the following information, in compliance with Article 13 Regulation (EU) 2016/679 (or General Data Protection Regulation, hereinafter referred to as “G.D.P.R.”), subsequent national adapting legislation (hereinafter referred to, jointly with the G.D.P.R., as the “Applicable Privacy Legislation“) and in compliance with Article 19 of the Federal Data Protection Act (hereinafter referred to as the “DPA”). During the consultation of the Site, information about users is, in fact, collected, which constitutes personal data within the meaning of the Applicable Privacy Legislation.

This information is provided solely for the above Site, and not for any other sites that can be reached through links on it.

Types of data processed

The following specifies the data that is processed by Avalon when you use the Site.

You assume responsibility for any third-party personal data you enter or post on the Site, and you warrant that you have the right to disclose or disseminate such data – thereby releasing Avalon from any liability to such third parties.

Personal data automatically acquired when visiting the Site

  • Browsing Data. Avalon automatically collects data about the device (pc, tablet, cell phone or other mobile device) and connection used by the user, including, for example, IP address, date and time of access, hardware and software information, event information about the device, unique identifiers, crash data.

  • Site Usage Data. Avalon collects information about how you used the Site, including, for example, the pages of the Site or other content you viewed and the links to other sites and applications that you clicked on.

Personal data provided directly by the user

  • Data provided through requests for information via e-mail. If the user, in order to request information, explicitly and voluntarily sends electronic mail to Avalon’s addresses indicated on the Site, or uses the form available under “Send Your Request” found in the “Contact Us” section, Avalon acquires the e-mail address and any personal data of the user (and/or third parties) included in the text of the electronic communication, as well as – for the “Send Your Request” form – the first name, last name, company name, e-mail address, telephone number and any personal data of the user (and/or third parties) included in the text of the message.

Personal data collected by cookies

Avalon uses cookies to collect data about user preferences on the Site.

Purpose of processing

To contribute to the operation of the Site; to provide the user with the services Avalon provides through the Site; to protect the user’s vital interests; to comply with applicable laws or pursue other public interest needs

User data, in fact, are processed:

  • To operate, measure, improve, and keep secure the Site and the services rendered through it;

  • to prevent, detect and mitigate security breaches and potentially prohibited or illegal activities.

Pursue the legitimate interests of Avalon in such a way that these interests do not override your fundamental rights and freedoms

User data, in fact, are processed:

  • to identify and resolve problems you experience in using the Site (e.g., blocked or non-functioning pages).

These treatments protect Avalon’s interest in keeping the Site functioning and efficient. They also do not infringe on the user’s fundamental rights and freedoms, as they are predictable and widespread treatments at each site. Moreover, these treatments also benefit the user himself, allowing the Site to continue to function.

With the user’s consent use statistical and marketing cookies

With your consent, your personal data (and/or that of third parties) may be processed for the purpose of:

  • Personalize, measure and improve the advertising provided to you on the Site and other websites, based on your preferences encountered while browsing the Site.

Mode of treatment

The user’s personal data are processed by means, computerized or telematic, exclusively for the purposes for which they were collected (see above), and stored for a determined period according to the criteria reported in this privacy policy (see below).

Personal data may be known and processed by Avalon’s staff, duly instructed about the precautions to be taken in accordance with the Applicable Privacy Regulations.

Avalon is obliged to take the necessary technical and organizational measures to ensure that the processing of personal data complies with the provisions on data protection, in particular with the principles set forth in Article 6, and shall adopt them by design.

Avalon processes the user’s personal data in a controlled and protected manner so that the user can be assured, through appropriate technical and organizational measures, that the security of personal data is appropriate to the risk.

Treatment duration

The specific retention times of the user’s personal data are documented in Avalon’s processing activity log (implemented in accordance with Article 30 of the G.D.P.R. and pursuant to Article 12 of the DPA.).

The user’s personal data are retained (in accordance with the criteria set forth in Recital 39 and Article 5(1)( e) of the G.D.P.R.) for a period necessary to ensure that the Site functions, and that Avalon provides users with the services provided through the Site. Such period, in any case, may not exceed 10 years from collection.

User’s personal data are destroyed or anonymized as soon as they are no longer necessary for the purpose of processing (according to Art.6 c.4 DPA).

The user’s personal data may be retained for longer periods than those just seen only in the event that this is necessary for Avalon to fulfill legal obligations incumbent on them or to protect a right in court.

After these retention periods expire, user data are either deleted, or permanently anonymized.

 

Disclosure of data

Avalon may disclose the personal data processed to the following individuals and purposes only.

Combating unlawful acts and security breaches

  • Avalon may disclose users’ personal data to third parties involved in preventing, detecting, and mitigating potentially unlawful acts and security breaches.

Law enforcement, judicial proceedings, and methods authorized by law

  • Avalon may disclose users’ personal data to Judicial Authorities, Public Authorities or authorized third parties in cases where the law so provides. As well as, in general, in cases where it is necessary to fulfill legal obligations or verified requests related to a criminal investigation or alleged illegal activity, or to respond to others’ claims about the rights, property or safety of Avalon, its employees or users.

 

Rights of data subjects

In the sole cases and with all the limitations provided for in Articles 15-22 G.D.P.R. and Articles 25-29 LPD, the user has the right – at any time, free of charge and without special charges and formalities – to:

  • Obtain confirmation that Avalon processes your personal data;

  • access to your personal data, and to know its origin, the purposes and purposes of processing, the period of storage, and information regarding third parties to whom the personal data is disclosed;

  • To revoke your consent at any time if it forms the basis of the processing;

  • Update or rectify your personal information collected by Avalon so that it is always accurate and precise;

  • Exercise the so-called right to be forgotten, i.e., to have your personal data collected by Avalon deleted from Avalon’s databases and/or archives, including backup archives;

  • Limit Avalon’s processing of your personal data;

  • object to processing, for those personal data processed to pursue public interest requirements or legitimate interests of Avalon;

  • to be notified, in a reasonable time, of any rectification, cancellation or restriction of processing ordered by Avalon, as well as any revocation of such measures and the reasons behind the revocations.

You may exercise these rights by written request addressed without formality to Avalon by sending appropriate e-mail to (e-mail: info@avalonsolution.ch).

Upon receipt of the aforementioned e-mail, Avalon will fulfill the request within one month of its receipt. This deadline may be extended by two months – upon notice to the user- taking into account the complexity and number of requests.

Avalon reminds the user that where the response to his or her requests has not been satisfactory in his or her opinion, he or she may address and lodge a complaint with the Data Protection Authority(http://www.garanteprivacy.it/) in the manner provided for in the Applicable Privacy Regulations.

Changes to the privacy policy

Avalon reserves the right to make changes to this privacy policy at any time by giving notice to users on this page of the Site.

Therefore, please consult this page often, taking as reference the date of last modification indicated at the bottom. Unless otherwise specified, in the event of a change, the previous privacy policy will continue to apply to personal data collected up to that time.

What are cookies

Cookies are small text files (usually formed by letters and numbers), which are stored on the device used by the user (computer, tablet, cell phone or other mobile device) and examined each time the user accesses the Site.
